You represent and warrant that you have all rights necessary to submit the User Content and that it does not infringe or violate the rights of any third party.

Klareda enables voice-based interactions between candidates and our platform. By using these features, you:

• Consent to the recording and processing of audio data
• Acknowledge that voice data may be analyzed by AI models
• Understand that we process this data in accordance with our Privacy Policy

7. Intellectual Property

All intellectual property rights in the Service, including all software, text, images, trademarks, and logos, are owned by or licensed to Klareda. You are granted a limited, non-exclusive, non-transferable license to access and use the Service solely for its intended purpose.

8. Subscription and Payment Terms

Access to certain features of the Service may require payment of subscription fees. Payment terms will be specified in the applicable order or pricing page. All fees are non-refundable unless otherwise stated.

9. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or engage in conduct that we determine to be harmful to the Service or its users. You may terminate your account by contacting us at support@klareda.com.

Upon termination, your right to use the Service will immediately cease. Sections 5, 7, 10, 11, and 12 shall survive termination.

The Service is provided "as is" and "as available." We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the fullest extent permitted by law, Klareda and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of or related to your use of the Service.

Our total liability to you for any claims arising under these Terms is limited to the amount you paid us for access to the Service in the 12 months prior to the event giving rise to the claim.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of Germany. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Berlin, Germany.

13. Changes to These Terms

We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website. Your continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.
